1. About These Terms
Defenity.co is operated by Ophir Commerce Systems Limited, company number 79477404, Unit 2A, 17/F Glenealy Tower, No. 1 Glenealy, Central, Hong Kong ("we", "us", "our"). These Terms of Service apply to everyone who visits our website or buys from us (together, the "Services"). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy. Please read them carefully, because they include warranty disclaimers and limits on our liability.
2. Who Can Order
To place an order you must be of legal age in your state of residence, or have the permission of a parent or guardian. You do not need to create an account to shop with us. You agree that the information you give us is correct, current and complete.
3. Our Products
We try to show our products as accurately as possible, but colors may look slightly different on your screen depending on your device and its settings. We may change product descriptions, stop selling a product or limit the quantities we sell at any time.
4. Orders and the Contract
When you place an order, you make an offer to buy. You receive an email confirming that we have received your order, and the contract is concluded when we confirm your order by email. We may decline or cancel an order, for example if a product is unavailable or we cannot verify the order. If that happens, we let you know by email and refund the full amount you paid. You agree that you are buying for your own personal use and not for resale.
5. Prices and Payment
All prices are in U.S. Dollars (USD). The price that applies is the one shown when you place your order. Promotions may have their own conditions, which apply alongside these Terms. If a price or product description contains an obvious error, we may correct it and, if your order is affected, cancel it and refund you in full. 6. Shipping and Delivery
We ship within the United States, free of charge. Delivery times are estimates, and we are not responsible for delays. See our Shipping Policy for details.
7. Returns, Refunds and Faulty Items
You can return items within 30 days of delivery, as described in our Returns & Refund Policy. If an item arrives faulty, damaged or not as ordered, email support@defenity.co with your order number and photos, and we will send a replacement or refund you.
8. Intellectual Property
All content on the Services, including text, images, graphics and our name and logo, belongs to us or our licensors. You may not copy or use it for commercial purposes without our written permission. See our IP & DMCA Policy.
9. Reviews and Feedback
If you send us reviews, comments or other content, you allow us to publish and use it in connection with our store. You agree that it will not be unlawful, offensive or misleading, and will not infringe anyone else's rights. We may remove content at our discretion.
10. Prohibited Use
You may not use the Services for anything unlawful or fraudulent, upload viruses or harmful code, interfere with the security of the website, or copy, scrape or automatically collect its content. If you break these rules, we may block your access to the Services.
11. Third-Party Tools and Links
The Services may include tools or links provided by other companies. We do not control them and are not responsible for their content, products or practices. Using them is at your own discretion.
12. Relationship with Shopify
Defenity is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Defenity. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Defenity, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Defenity.
13. Disclaimer of Warranties
To the extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind beyond those stated in these Terms and our policies. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer protection law.
14. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, such as lost profits or lost data, arising from your use of the Services or products bought through them. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnification
To the extent permitted by law, you agree to compensate us for losses and costs caused by your breach of these Terms or your violation of any law or the rights of others.
16. Termination
If you breach these Terms, we may end our agreement with you and block your access to the Services. Sections 8, 9, 13, 14, 15, 17 and 18 continue to apply after termination.
17. General Provisions
If any part of these Terms is found invalid, the rest remains in force. If we do not enforce a right, this does not mean we waive it. These Terms, together with the policies referred to in them, form the entire agreement between you and us about the Services. You may not transfer your rights or obligations under these Terms to anyone else without our consent. Headings are for convenience only.
18. Governing Law
These Terms are governed by the laws of Hong Kong, where our company is registered. This does not take away the protection you have under the consumer protection laws of the state where you live, and you may bring a claim before the courts where you live.
19. Changes to These Terms
We may update these Terms from time to time. The current version is always on this page. Changes apply only to orders placed after the new version is published.
